Terms of Service

1. Acceptance of Terms
By accessing or using the Afterpath platform (afterpath.life), including our website, tools, and services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.
You represent that you are at least 18 years of age and have the legal capacity to enter into this agreement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of Service
Afterpath provides a digital platform to help families and professionals navigate estate settlement, probate processes, and eldercare logistics, with a current focus on North Carolina. Our Service includes:
- AI-powered task management with personalized, auto-calculated deadlines
- County-specific compliance guidance for NC’s 100 counties
- Pathfinder: an AI-powered Q&A guide for NC probate and estate questions
- Professional referral connections
- Document tracking and deadline management
Features may change, be added, or be removed at our discretion as we continue to develop the platform.
3. Not Legal, Financial, or Professional Advice
Critical Disclaimer: Afterpath is a technology platform, not a law firm, accounting firm, or financial advisory practice. Nothing provided through the Service constitutes legal, financial, tax, or professional advice. No attorney-client, fiduciary, or professional-client relationship is created by your use of Afterpath.
The information, tools, task lists, and guidance provided through Afterpath are for general informational purposes only. You should always:
- Consult a qualified attorney for legal advice specific to your situation
- Consult a qualified financial advisor for financial decisions
- Consult appropriate licensed professionals for tax, real estate, and insurance matters
- Independently verify all information before relying on it for legal filings, financial transactions, or estate decisions
You acknowledge and agree that you bear sole responsibility for all legal, financial, and estate-related decisions you make, regardless of any information or guidance provided by Afterpath.
4. AI-Powered Features Disclaimer
AI Limitation Notice: Afterpath uses artificial intelligence to generate task lists, answer questions, calculate deadlines, and provide guidance. AI systems can and do produce inaccurate, incomplete, or outdated information.
By using our AI-powered features, you acknowledge and agree that:
- AI-generated outputs may contain errors, omissions, or inaccuracies
- AI outputs are not a substitute for professional legal, financial, or tax advice
- You must independently verify all AI-generated information before acting on it
- Afterpath does not guarantee the accuracy, completeness, or timeliness of any AI output
- Laws, regulations, court rules, and county procedures change frequently; AI outputs may not reflect the most current requirements
- You should not rely solely on AI outputs for any legal filing, court deadline, or financial decision
5. Account Registration
To access certain features of the Service, you may be required to create an account. You agree to:
- Provide accurate, current, and complete registration information
- Maintain the security of your password and account credentials
- Promptly notify us of any unauthorized use of your account
- Accept responsibility for all activity under your account
- Maintain only one account per person (unless authorized for professional use)
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are fraudulent.
6. Waitlist & Early Access
During our waitlist and early access period:
- Joining the waitlist does not guarantee access to the Service or any specific features
- We reserve the right to grant, deny, or revoke access at our discretion
- “Free year” promotions are subject to specific terms communicated at enrollment and may be modified or discontinued
- Early access features may be incomplete, contain bugs, or change significantly before general release
- We may collect feedback from early access users and use it to improve the Service
- Early access participants understand they are using a product in active development
7. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose or in violation of applicable laws
- Submit false, misleading, or fraudulent estate information
- Impersonate another person or misrepresent your authority to act on behalf of an estate
- Upload malware, viruses, or other harmful code
- Attempt to gain unauthorized access to our systems or other users’ accounts
- Scrape, crawl, or use automated tools to extract data from the Service without permission
- Use the Service to engage in unauthorized practice of law or other professional services
- Interfere with or disrupt the Service or its infrastructure
- Reverse-engineer, decompile, or attempt to discover the source code of any part of the Service
8. User Content & Estate Data
Ownership
You retain ownership of all content, documents, and data you submit to the Service (“User Content”).
License
By submitting User Content, you grant Afterpath a limited, non-exclusive, worldwide license to process, store, display (to authorized users), and use your content solely as necessary to provide and improve the Service.
Confidentiality
We treat all User Content, especially estate and probate data, as confidential. We will not access or review your content except as necessary to provide the Service, respond to support requests, or comply with legal requirements.
Your Representations
You represent that you have the legal authority to submit the estate data you provide (e.g., as executor, administrator, power of attorney, or authorized family member) and that your use of the Service does not violate any court order, fiduciary duty, or applicable law.
9. Professional Users (Attorneys, Advisors, Agencies)
If you use the Service in a professional capacity, the following additional terms apply:
- Professional ethics: You are solely responsible for compliance with your professional ethics rules, bar regulations, and licensing requirements
- Client consent: You represent that you have obtained any necessary consent from your clients before entering their information into the Service
- No unauthorized practice: Use of Afterpath does not authorize the practice of law, financial advice, or other regulated professional services by non-licensed individuals
- Client relationships: Your professional relationship with your clients is separate from and not governed by these Terms. Afterpath is not responsible for your professional obligations to your clients
- Data responsibility: You are responsible for ensuring that your use of client data through the Service complies with applicable professional conduct rules and privacy requirements
10. Intellectual Property
The Service, including all software, content, design, graphics, AI models, documentation, and branding, is owned by Afterpath, LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any part of the Service without our written consent.
If you provide suggestions, ideas, or feedback about the Service, you grant us a perpetual, irrevocable, non-exclusive license to use that feedback without compensation or attribution.
11. Payment Terms
Current status: Afterpath is currently in a free waitlist/early access phase. The following terms will apply when paid subscriptions become available:
- Subscription fees will be billed in advance on a monthly or annual basis
- All fees are in US dollars and non-refundable except as required by law or as stated in our refund policy
- We will provide at least 30 days’ notice before any price increase
- Failure to pay may result in suspension or termination of access
- You are responsible for all applicable taxes
12. Subscription & Cancellation
- You may cancel your subscription at any time through your account settings or by contacting us
- Cancellation takes effect at the end of your current billing period
- Upon cancellation, you may request an export of your data within 30 days
- After 30 days post-cancellation, your data will be retained for the period described in our Privacy Policy, then deleted
13. Third-Party Services
The Service may contain links to or integrations with third-party websites, services, or professionals. These third parties are not controlled by Afterpath, and we are not responsible for their content, practices, or services. Any referral to a third-party professional is for convenience only and does not constitute an endorsement. Your interactions with third parties are governed by their own terms and policies.
14. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.
15. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the fullest extent permitted by law, Afterpath disclaims all warranties, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Any warranty that the Service will be uninterrupted, error-free, or secure
- Any warranty regarding the accuracy, completeness, or timeliness of AI-generated content, task lists, deadline calculations, or county-specific guidance
- Any warranty that the Service will meet your specific requirements or expectations
16. Limitation of Liability
To the maximum extent permitted by law:
- Cap on damages:Afterpath’s total liability to you for all claims arising from or related to the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100
- Excluded damages: Afterpath shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or opportunity
- Estate decisions: Afterpath is not liable for any losses, damages, penalties, fines, or other consequences arising from estate, probate, legal, or financial decisions you make based on information provided through the Service
- Missed deadlines: While we strive for accuracy in deadline calculations, Afterpath is not liable for missed court deadlines, filing deadlines, or other time-sensitive obligations
Some jurisdictions do not allow the exclusion of certain warranties or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
17. Indemnification
You agree to indemnify, defend, and hold harmless Afterpath, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from:
- Your use of the Service
- Your User Content or estate data
- Estate, probate, legal, or financial decisions you make using the Service
- Your violation of these Terms
- Your violation of any third party’s rights
- For professional users: any claim by your clients related to your use of the Service
18. Assumption of Risk
By using the Service, you acknowledge and agree that:
- Estate settlement, probate, and eldercare involve complex legal, financial, and emotional decisions
- Afterpath is a digital tool designed to assist and organize, not to replace qualified legal, financial, or professional counsel
- You bear all risk associated with decisions you make based on information from the Service
- Laws and regulations change frequently, and the Service may not always reflect the most current requirements
- County-specific procedures, fees, and forms may vary and change without notice to Afterpath
- You should always verify critical information directly with the relevant county office, court, or qualified professional
19. Dispute Resolution & Arbitration
Informal Resolution First
Before filing any formal dispute, you agree to contact us at legal@afterpath.life and attempt to resolve the dispute informally for at least 30 days.
Binding Arbitration
Any dispute that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Wake County, North Carolina, or at another mutually agreed location.
Individual Claims Only
You agree that disputes will be resolved on an individual basis. You waive your right to participate in a class action, class arbitration, or any other representative proceeding.
Exceptions
Either party may bring claims in small claims court (if the claim qualifies) or seek injunctive relief in court for intellectual property infringement.
20. Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law provisions. For any disputes not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Wake County, North Carolina.
21. General Provisions
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect
- Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Afterpath regarding the Service
- Assignment: You may not assign or transfer these Terms without our consent. We may assign our rights and obligations without restriction
- Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision
- Force majeure: Afterpath is not liable for any failure or delay due to causes beyond our reasonable control, including natural disasters, pandemics, government actions, or internet disruptions
- Notices: We may provide notices via email, through the Service, or by posting on our website. Notices to us should be sent to legal@afterpath.life
